Terms of Service

Welcome to Auto QC. These Terms of Service ("Terms") govern your access to and use of the Auto QC platform, services, and website (collectively, the "Service") operated by The Universal Method LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using Auto QC, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
2. Service Description
Auto QC is an AI-powered quality control platform for call and conversation analysis. The Service provides:
- Call Intake: Tools to upload or send call recordings, transcripts, and related metadata to the platform, including via API
- Processing and Transcription: Processing of submitted calls through analysis pipelines, including transcription of audio where a transcript is not supplied
- Quality Analysis: AI-assisted scoring of call quality, compliance, and performance against criteria you configure
- Reporting: Dashboards, scorecards, and reports for tracking quality metrics over time, with export capabilities
- Team Access: Multi-user accounts with role-based permissions (admin, editor, and viewer roles)
- AI Assistant: An in-app assistant that can answer questions about your data
2.1 AI-Generated Output; Human Review Required
Analysis, transcripts, and scores produced by the Service are generated in whole or in part by artificial intelligence, including large language models provided by third parties such as Anthropic. AI-generated output may contain errors, omissions, or mischaracterizations. All scores and analyses are advisory only. You agree that you will not rely on the Service as the sole basis for any decision that has legal or similarly significant effects on an individual — including hiring, discipline, compensation, or termination of an employee or agent — and that a qualified human will review the underlying interaction before any such decision is made. We make no warranty that any score, transcript, or analysis is accurate, complete, or error-free.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to provide advance notice of significant changes that may affect your use of the Service.
3. Eligibility
To use the Service, you must:
- Be at least 18 years of age or the age of legal majority in your jurisdiction
- Have the legal authority to enter into these Terms on behalf of yourself or the organization you represent
- Not be prohibited from using the Service under applicable laws
- Comply with all applicable laws regarding the recording and analysis of communications in your jurisdiction
If you are using the Service on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" refers to both you individually and the entity.
4. Account Registration and Security
4.1 Account Creation
To access certain features of the Service, you must create an account. When registering, you agree to provide accurate, current, and complete information and to update this information as necessary to maintain its accuracy. You must verify your email address before your account is activated. Account signup is protected by Google reCAPTCHA (see Section 13.5).
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Use a strong, unique password for your account
- Not share your account credentials with any third party
- Immediately notify us of any unauthorized access to your account
- Ensure that you log out of your account at the end of each session when using shared devices
We are not liable for any loss or damage arising from your failure to protect your account credentials.
4.3 Account Termination
You may terminate your account at any time by contacting our support team. Upon termination, your right to access the Service will cease immediately. We may retain certain data as required by law or for legitimate business purposes.
5. Credits, Billing, and Payment
5.1 Credit System
Auto QC operates on a prepaid credit system. Credits are used to pay for call analysis services:
- Credit Value: One (1) credit equals one (1) minute of call analysis
- Minimum Charge: Each call processed incurs a minimum charge of two (2) credits, regardless of duration
- Signup Bonus: New accounts receive 500 free credits upon registration, provided as a one-time bonus
- Credit Expiration: Credits never expire and remain in your account until used
5.2 Credit Purchases
Credits can be purchased through our platform at the then-current rates. All prices are displayed in US Dollars unless otherwise specified. Prices are subject to change, but changes will not affect credits already purchased.
5.3 Auto-Recharge
You may enable auto-recharge to automatically purchase additional credits when your balance falls below a specified threshold. By enabling auto-recharge, you authorize us to charge your payment method on file for the designated amount. You can disable auto-recharge at any time through your account settings.
5.4 Payment Terms
All payments are processed securely by Stripe, our third-party payment processor. Your card details are collected and stored by Stripe; we never store your full card number on our systems. By providing payment information, you represent that you are authorized to use the payment method. You agree to pay all charges incurred under your account, including applicable taxes and fees.
5.5 Refunds
Credit purchases are non-refundable except as required by applicable law. In addition, we may, at our sole discretion, provide refunds or credits in cases of:
- Service errors that result in incorrect credit deductions
- Processing failures caused by our systems
- Other circumstances we deem appropriate

5.6 Referral Program
We may offer a referral program under which you receive a commission (currently 20%) on qualifying credit purchases made by customers you refer. Referrals are tracked via a referral link and cookie. We may modify or discontinue the referral program, adjust commission rates prospectively, and withhold commissions for self-referrals, fraud, or abuse. Commissions accrue to your account as described in the Service.
6. Acceptable Use Policy
6.1 Permitted Use
You may use the Service only for lawful purposes and in accordance with these Terms. You agree to use the Service only for:
- Quality control and analysis of lawfully recorded communications
- Training and performance improvement purposes
- Compliance monitoring and documentation
- Other legitimate business purposes
6.2 Prohibited Activities
You agree not to:
- Upload or process recordings that were obtained illegally or without proper consent
- Use the Service to violate any applicable law or regulation, including wiretapping, eavesdropping, or privacy laws
- Upload content that contains malware, viruses, or harmful code
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Use the Service to harass, abuse, or harm another person
- Reverse engineer, decompile, or disassemble any aspect of the Service
- Use automated means to access the Service except through our approved API
- Resell, sublicense, or redistribute access to the Service without our written permission
- Upload recordings containing content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
6.3 Recording Consent
You are solely responsible for ensuring that all recordings uploaded to the Service were obtained in compliance with all applicable laws, including obtaining any required consent from all parties to the recorded communications. Laws regarding recording consent vary by jurisdiction (one-party vs. all-party consent states/countries). We strongly recommend consulting with legal counsel to ensure compliance.
6.4 Scheduled Report Email Recipients
The Service allows you to configure scheduled reports to be delivered via email to recipients of your choosing. By using this feature, you acknowledge and agree that:
- You are solely responsible for ensuring you have the proper authorization, consent, and legal right to send reports to each email recipient you configure
- You will only add email addresses of individuals who have consented to receive such communications from you
- You will comply with all applicable anti-spam laws, including the CAN-SPAM Act, GDPR, CASL, and any other relevant regulations
- The Company is not responsible for any claims, damages, or legal actions arising from your unauthorized or improper use of the scheduled email feature
- You will promptly remove any recipient who requests to stop receiving reports
The Company acts solely as a technical service provider in delivering scheduled reports. We do not verify recipient consent and assume no liability for communications sent at your direction. Misuse of this feature, including sending unsolicited emails, may result in immediate termination of your account.
7. Data and Privacy
7.1 Your Data
You retain all rights to the audio recordings and data you upload to the Service ("Your Data"). By uploading content to the Service, you grant us a limited, non-exclusive license to process, analyze, and store Your Data solely to provide the Service to you.
7.2 Data Processing; Roles
We process Your Data as described in our Privacy Policy. With respect to personal data of call participants contained in recordings, transcripts, and metadata you submit, you (or your organization) are the data controller and we act as your data processor (or service provider): we process that data only to provide the Service to you and on your instructions. Processing includes the use of third-party AI subprocessors (such as Anthropic's Claude API) and the other subprocessors listed in the Privacy Policy. By using the Service, you acknowledge and agree to our data practices as described therein.
7.3 Data Security
We implement industry-standard security measures to protect Your Data. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security. You are responsible for maintaining the security of your account credentials and for any activities that occur under your account.
7.4 Data Retention and Deletion
We retain call recordings, transcripts, scores, and related data while your account remains active, so that your history and reporting stay available to you, and as described in our Privacy Policy. There is currently no self-serve deletion tool in the product; you may request deletion of specific data or of your entire account by contacting [email protected], subject to our legal obligations and legitimate business interests.
8. Intellectual Property
8.1 Our Intellectual Property
The Service, including its design, features, functionality, software, algorithms, text, graphics, logos, and other content, is owned by the Company and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
8.2 Your Intellectual Property
You retain all intellectual property rights in Your Data. We do not claim any ownership rights in the content you upload to the Service.
8.3 Feedback
If you provide us with feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback into the Service without any obligation to you.
9. Limitation of Liability
9.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT AI-GENERATED TRANSCRIPTS, SCORES, OR ANALYSES WILL BE ACCURATE, COMPLETE, OR ERROR-FREE. AS STATED IN SECTION 2.1, ALL AI OUTPUT IS ADVISORY AND MUST BE REVIEWED BY A HUMAN BEFORE BEING USED FOR ANY DECISION WITH LEGAL OR SIMILARLY SIGNIFICANT EFFECTS ON AN INDIVIDUAL.
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
9.3 Cap on Liability
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED DOLLARS ($100).
10. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including privacy or intellectual property rights
- Any content you upload to the Service
- Your failure to obtain proper consent for recorded communications
11. Termination
11.1 Termination by You
You may terminate your account at any time by contacting our support team at [email protected]. Upon termination, you will lose access to the Service and any unused credits in your account, except where a refund is required by applicable law.
11.2 Termination by Us
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to:
- Violation of these Terms
- Fraudulent, illegal, or abusive activity
- Non-payment or payment disputes
- Extended periods of inactivity
- Requests by law enforcement or government agencies
11.3 Effect of Termination
Upon termination, your right to use the Service will cease immediately. Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
12. Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
12.2 Informal Resolution
Before filing a formal dispute, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.
12.3 Arbitration
Any dispute arising from or relating to these Terms or the Service that cannot be resolved informally shall be resolved by binding arbitration in accordance with the American Arbitration Association's rules. The arbitration shall be conducted in Delaware, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
12.4 Class Action Waiver
You agree that any proceedings to resolve disputes will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, you waive any right to a jury trial.
13. General Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements and understandings.
13.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions will remain in full force and effect.
13.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
13.4 Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
13.5 Third-Party Services
The Service is built on third-party services, including Amazon Web Services (hosting), Stripe (payment processing), and Anthropic (AI processing via the Claude API). A full list of subprocessors appears in our Privacy Policy.
This site uses reCAPTCHA to protect against spam and abuse. Use of reCAPTCHA is subject to the Google Privacy Policy and Terms of Service.
